Contractors or individuals performing specialized work, i.e. wire-line or pipeline under-crossings, generally carry commercial general contractors liability insurance. By and large the contractors liability insurance will not apply when the work is being performed within fifty feet (50’) of any railroad tracks. If there were an unexpected accident under this scenario the railroad would assume full responsibility. Hence the need for additional insurance. The railroad protective policy, along with properly endorsed general commercial liability coverage, protects the railroad in case of a third party claim. Railroad Protective Insurance can be obtained through most insurance providers.
